| Is Carbon Monoxide a Pollutant Under Insurance Contracts? »
On February 14, 2007, the Iowa Court of Appeals issued a decision entitled Heartland Specialty Foods and Allied Insurance v. Johnson. This is a worker’s compensation case involving physical-mental injuries. The Iowa Court of Appeals held that there is no need for a compensable physical injury to award benefits for a mental injury In this case, the injured worker was involved in an altercation at work and was struck by a co-worker. Even though a minor physical injury was sustained, the worker was permitted to seek benefits for a mental injury. Ultimately, the injured employee received a permanent total disability award and will receive benefits for the remainder of her life or until she is capable of returning to work.
